Helping Individuals and Businesses Permanently Discharge Debts

If you are an individual facing financial challenges, whether because of an accident or illness, a divorce, the loss of a job, or for any other reason, what you may really need is the fresh start that a Chapter 7 bankruptcy can provide. If your business has little or no prospect of making it through today's troubled business environment, your best option may be to permanently discharge your debts under Chapter 7. In either case, you want an experienced lawyer to guide you through the process, so that you accomplish your objectives in the process.

At Bruner Wright, P.A., we have over 30 years of experience assisting people in consumer bankruptcy matters, including efforts to discharge debt through a Chapter 7 bankruptcy filing. We built our successful practice by combining a commitment to personal service and attention with a high level of responsiveness to the needs of our clients. When you call our offices, you will always get to speak with a Chapter 7 bankruptcy attorney. For a free initial consultation, contact our office by email or call us at 850-385-0342.

Our Chapter 7 Bankruptcy Practice

In a Chapter 7 bankruptcy filing, you are allowed to permanently discharge certain debts (student loans, child support arrearages and some taxes may be excluded) in exchange for the sale of nonexempt assets. Immediately upon filing your petition for bankruptcy, an automatic stay goes into effect, prohibiting your creditors from contacting you or taking any legal action against you to collect the debt (other than through the bankruptcy proceeding).

Under the recent revisions to the bankruptcy laws, you must qualify to discharge your debts under Chapter 7 through a means test. You will only be allowed to seek protection under Chapter 7 if the bankruptcy court determines that you lack the "means" to repay your creditors in full over a three- to five-year period.

When you hire us to advise you in a personal bankruptcy matter, we will run our own means test to see if you meet the requirements for filing under Chapter 7. If so, we will prepare and file all the paperwork to initiate the process and will represent you in all meetings, hearings or other proceedings related to the bankruptcy. We will make certain that you understand, before you file, what can and cannot be discharged in a Chapter 7 bankruptcy proceeding. We will also verify that all exempt assets are excluded from the bankruptcy sale.
